We take data privacy seriously.  This privacy statement explains what personal data Brain Corp (“Brain”) collects from you, through our interaction with you and through our products and services, and how we use that data.

About Us

We are a San Diego-based AI company that partners with manufacturers of commercial equipment and consumer electronics to convert their manually operated products into autonomous robots. Our technology represents the next generation of artificial brains for robots. We are funded by the SoftBank Vision Fund and Qualcomm Ventures. Why We Collect Information

We collect data to operate effectively and provide you the best experience with our products and services.  You provide some of this data directly. In other instances, we get some of it by recording how you interact with our products and services.  Data is critical for building smarter robots and is what makes our products possible. You help build this data. The data your robots generate feeds into our machine learning algorithms, software development, data analysis, and testing.  The data is also used to support the products you purchase through data analytics. Without the ability to leverage data across a wide variety of applications, stores, and customers, our robots would not be able to perform as they do today.

Information We Collect

While engaging with our products and services, you may provide personal information about you, your company name, employee or employer names, contact information, billing information, identification numbers, information about your customers, and certain information about Brain products and services purchased by you and where you use such products and services.

We will let you know prior to collection of this data whether the provision of personal information we are collecting is voluntary, and if so, the consequences of not providing the information.  By giving us this data, you agree to this information being collected, used and disclosed in our Terms of Use and in this privacy statement.

In addition, we may host and receive data on domestic and/or foreign servers, including but not limited to, servers in the United States.

The following information may be collected by us:

  • Through our products and services, including our website, autonomy services, customer service inquiries, software application, Brain products, email messages, or other digital services.
  • From other sources, including public databases, social media platforms, joint marketing partners and/or programs, webpages and third-party vendors.
  • Through sensors, including data generated by sensors of Brain products.  Data from sensors provides critical information for Brain products to navigate their surroundings.
  • Through telematics data, including data collected by our navigation modules relating to performance, usage, operation, condition, identification, speed, odometry, battery usage, system functionality, software/firmware version, location, software usage, safety-related data, cleaning schedule, maintenance and other data to analyze the performance of Brain products and to improve Brain’s products and services.
  • While servicing, including information gathered by us or our partners to provide maintenance and service to your Brain products.  This information can include identification numbers, repair history, any outstanding recalls, any bills due, any complaints and feedback, and any other information related to the service history of your Brain products.
  • Offline, including information collected during meetings with Brain representatives, visits to our offices, presentations by Brain, placement of orders, and contact with Brain’s customer services or sales department.  We may also receive your information through Brain partners with whom you engage.

How We Use Your Information

We may use the personal information we receive about you for our legitimate business interests, including:

  • To enforce compliance with our Terms of Use and applicable law.  This may include developing tools and algorithms that help us prevent violations.
  • To protect the rights and safety of our customers, vendors, suppliers and licensees, as well as our own.

In addition, we may use received information for the following purposes:

  • To meet legal requirements, including complying with court orders, valid discovery requests, valid subpoenas and other appropriate legal mechanisms
  • To provide information to advisers, including attorneys and accountants, to help us comply with legal, accounting, or security requirements
  • To prosecute and defend a court, arbitration, or similar legal proceeding
  • To respond to lawful request by public authorities, including to meet national or international security or law enforcement requirements

  • To respond to your inquiries and fulfill your requests
  • To evaluate feedback and performance of our products during an on-site evaluation
  • To complete and fulfill purchase and subscriptions
  • To provide services to Brain products, including to provide service recommendations, performance tips, and to deliver updates to Brain products
  • To advise of important safety-related information
  • To send administrative information to you, such as information regarding our products and services purchased by you and changes to our terms, conditions and policies
  • To monitor the performance of and provide services relating to our products
  • To present products and offers specifically tailored to you
  • To provide useful summary data related to our products and services
  • To create maps and other aggregate information derived from sensor and telematics data
  • For Brain’s business purposes, including data analysis, audits, enforcing our terms and conditions, developing and modifying new products and services, and other business activities conducted by us

Securing Your Information

Specifically, we safeguard your personal information in the following ways:

  • We encrypt electronic data using a key length of at least 128 bits when transmitting and storing data
  • We stipulate security guidelines to our employees providing for physical, organizational, administrative, and technical controls; we will only provide access to your confidential information on a need-to-know basis.
  • We have in place non-disclosure agreements and demands for security measures with third-parties that have access to data in aiding Brain in using such data in accordance with our “How We Use Your Information” section
  • We conduct independent third-party penetration testing to detect any material security weaknesses in our technology infrastructure
  • We aggregate and anonymize data, where applicable

Retaining Your Information

We retain your personal information where we have an ongoing legitimate business or legal need to do so.  Our retention periods will vary depending on the type of data involved, but generally we will refer to these criteria to determine the retention period:

  • Whether we have a legal or contractual need to retain the data
  • Whether the data is necessary to provide our services

When we have no ongoing legitimate business need to retain your personal information we will either delete or anonymize it or, if that is not possible (for example, your personal information has been stored in backup archives), then we will securely store your personal information and isolate it from any further processing until deletion is possible.  We do not have an obligation to retain your personal information for any specific length of time.

We may change this privacy statement at any time and from time to time.  The most recent version of this privacy statement is reflected by the version date located at the top of this privacy statement.  All updates and amendments are effective immediately upon notice, which we may give by any means, including, but not limited to, by posting a revised version of this privacy statement or other notice on our website.  We encourage you to review this privacy statement often to stay informed of changes that may affect you. Our electronically or otherwise properly stored copies of this privacy statement are each deemed to be the true, complete, valid, authentic, and enforceable copy of the version of this privacy statement that was in effect on each respective date you visited our website.
